1. Scope and Contracting Parties

These Terms and Conditions govern the use of JawBuddy's digital health platform (website and mobile application). The service provider is JawBuddy UG (haftungsbeschränkt), Nobelstr. 10, 70569 Stuttgart, Germany. Contact: legal@jawbuddy.com, +49 160 92303560.

Coverage includes the website, mobile app (iOS/Android), associated services, and both free and paid usage.

2. Definitions

Service: All digital health offerings including website, app, and backend services
User: Any natural or legal person using the service or with an account
Health Data: Personal data relating to health status, symptoms, treatment progress, or physical measurements
TrueDepth Data: Data from the iOS device's TrueDepth camera for facial recognition and movement analysis
Treatment Content: Exercises, videos, instructions, and therapeutic content
Subscription: Paid use with enhanced features

3. Contract Formation and User Account

3.1 Registration Requirements

Users must provide truthful, complete information including a valid email address and secure password, and agree to these terms and our privacy policy.

3.2 User Account Responsibilities

Users are responsible for account security, must report unauthorized use immediately, may not share accounts with third parties, and must maintain current information.

3.3 Eligibility

The service is for persons aged 18 and older. Minors require consent from their legal guardians. Commercial use without permission, credential sharing, and reverse engineering are prohibited.

4. Services and Functionality

4.1 Main Services

Personalized treatment plans and exercises, symptom tracking and progress analysis, AR-assisted jaw opening measurement using TrueDepth, AI-powered companion messages, detailed onboarding assessments, weekly health screenings, and treatment progress documentation.

4.2 Service Limitations

The service is a wellness and prevention offering and does not replace medical treatment. It provides no medical diagnosis, treatment, emergency care, medication prescription, or replacement for professional medical advice.

4.3 Availability

We strive for high availability but cannot guarantee 100% uptime. Maintenance is performed outside peak hours when possible.

5. TrueDepth Camera and Facial Recognition

5.1 What We Collect

Collected: Jaw opening distance (millimeters only)
Not Collected: Face images, geometry, biometric identifiers, facial recognition data
Processing: 100% on-device via Apple's ARKit
Storage: Raw face data is NEVER stored — only numerical measurements
Sharing: No face data is shared with third parties

5.2 No Biometric Identification

JawBuddy does NOT use face data for biometric identification or facial recognition. The TrueDepth camera functions solely as a measurement tool.

6. Health Data and Medical Information

Medical Notice: JawBuddy is not a medical device and does not replace medical treatment.

Collected health data includes pain intensity/location, jaw opening width/mobility, bruxism symptoms/frequency, treatment progress, and self-assessments. We do not collect medical diagnoses, laboratory values, imaging results, medication intake, therapy plans, or emergency contacts.

Users should consult doctors for persistent symptoms, seek immediate help for emergencies, maintain dental check-ups, and use JawBuddy as supplementary to medical treatment.

7. Subscription and Payment

JawBuddy offers Lifestyle Training as a monthly or annual auto-renewable subscription. All payments are processed through the Apple App Store as In-App Purchases. Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the current period ends. Prices include statutory VAT where applicable.

Subscriptions are managed through Apple ID Account Settings (Settings > Apple ID > Subscriptions). Cancellation takes effect at the billing period's end. Refunds follow Apple's policies.

8. Usage Rules and Prohibited Activities

The service is intended for personal health promotion, symptom documentation, exercise participation, and support team communication. Prohibited activities include commercial misuse, hacking/manipulation, sharing credentials, uploading malware, copyright violation, user harassment, and spreading false information.

JawBuddy reserves the right to warn users, temporarily block accounts, permanently terminate contracts, or pursue legal action for violations.

9. Intellectual Property

JawBuddy UG holds all rights to the platform including software copyrights, trademark rights, treatment content, and algorithm/AI model rights. Users receive a limited, non-transferable license for personal, non-commercial use only. The license expires upon contract termination.

10. Disclaimer and Warranty

Use of the service is at your own risk. The service is provided “as is” with no warranty for specific results, uninterrupted availability, or error-free software. Liability extends only to intent, gross negligence, injury to life/body/health, product liability, and mandatory legal provisions.

11. Contract Termination

Users may terminate anytime via app settings or email (support@jawbuddy.com). Termination takes effect at the billing period's end. Upon termination, service access is blocked and personal data is deleted (except legally required data). Health data is anonymized or deleted.

12. Changes to These Terms

JawBuddy reserves the right to modify these terms for legal/technical requirements, service expansion, or business changes, with at least 30 days' notice via email or app notification. Important changes require express consent.

13. Applicable Law and Jurisdiction

These terms are subject to German law, excluding the UN Convention on Contracts for the International Sale of Goods. Berlin is the jurisdiction for disputes involving merchants or legal entities under public law.
