Progressive Muscle Relaxation for Stress Reduction and Promoting the Ability to Relax – online course with the JawBuddy app

§ 1 Scope and provider

These terms of use apply exclusively to the booking and completion of the prevention course “Progressive Muscle Relaxation for Stress Reduction and Promoting the Ability to Relax – online course with the JawBuddy app” (the “Prevention Course”). The provider is JawBuddy UG (haftungsbeschränkt), Nobelstraße 10, 70569 Stuttgart, Germany, HRB 803535, Local Court of Stuttgart (the “Provider”). The Provider’s general terms of use apply to all other content and functions of the JawBuddy app; within the scope of the Prevention Course, these terms prevail.

§ 2 Subject of the contract

The Prevention Course is an eight-week ICT online course within the meaning of Chapter 5 of the German statutory health insurance Prevention Guideline (Sec. 20 (4) no. 1 SGB V) in the field of stress and resource management, prevention principle promotion of relaxation. It teaches Progressive Muscle Relaxation (PMR) according to Jacobson. The course comprises eight modules of approx. 45 minutes each, unlocked on a weekly basis, plus four accompanying participant handouts. Participation is location- and time-independent via the JawBuddy app (iOS).

§ 3 Delimitation; no therapy

The Prevention Course is a standalone primary prevention offering. It is not part of the other content of the JawBuddy app (in particular not of the section with exercises for craniomandibular complaints) and vice versa; such content is not subject of this contract.

The Prevention Course is not a medical, therapeutic or psychotherapeutic treatment and does not replace one. No diagnostic or therapeutic services are provided.

Purchasing the Prevention Course does not create a subscription or membership. There is no automatic renewal and no recurring charge.

§ 4 Participation requirements and contraindications

The course is intended for healthy adults between 18 and 65 years of age. Persons with the contraindications listed in the booking process and the participant materials are excluded from participation (in particular severe mental health conditions requiring treatment, acute mental health crises, acute pain or injuries of the musculoskeletal system, postoperative conditions, medical advice against relaxation techniques). Freedom from contraindications must be actively confirmed before booking; without this confirmation, booking is technically not possible. If health complaints occur during participation, the exercise must be stopped immediately and medical or psychotherapeutic advice sought if complaints persist.

§ 5 Booking, price and payment

Booking takes place in the JawBuddy app via Apple’s in-app purchase process. The course price is shown in the booking process and is due once in advance (one-time payment, no subscription). After purchase, the participant automatically receives an invoice by email to the address provided at booking; the invoice is suitable for submission to the statutory health insurer.

§ 6 Course flow, unlocking and learning check

The eight modules are completed in a fixed order. After completing a module, the next module is unlocked after a seven-day waiting period; the weekly unlock is the earliest possible time, not a mandatory deadline.

A module is deemed completed when the audio has been listened to in full and the knowledge quiz has been passed (at least 2 out of 3 questions correct). The knowledge quiz is a mandatory, fixed part of every course unit (learning check) and can be repeated as often as needed if not passed.

Modules already completed remain accessible for the duration of the contract.

§ 7 Certificate of participation and reimbursement

After full completion of all eight modules (100 percent; complete audio and passed quiz in each case), the certificate of participation is created automatically in accordance with the template of the Zentrale Prüfstelle Prävention and sent together with the invoice by email to the address provided at booking. Whether and to what extent a statutory health insurer subsidises the course fee depends on the conditions of the respective insurer; there is no claim against the Provider for reimbursement. The insurer’s subsidy is not offset against contributions or other benefits; participation is not tied to any membership.

§ 8 Professional support and technical support

Professional supervision of the course is provided by the course instructor Moritz Scherer (physiotherapist, ZPP certification for the prevention principle promotion of relaxation). For questions about the course content as well as technical and organisational matters, the single contact address support-praevention@jawbuddy.com is available; incoming requests are internally assigned to the course instructor or technical support. Requests are answered within 48 hours, including weekends and public holidays. A video appointment with the course instructor can be arranged if needed.

§ 9 Access after course completion

After completing module 8, participants retain full access to all eight course modules for six months. Access to the course content then ends without the need for termination.

§ 10 Right of withdrawal

Consumers have a statutory right of withdrawal for contracts concerning digital content. The purchase is processed via Apple’s in-app purchase system; withdrawal and refunds are governed by the procedures established by Apple and by statutory provisions. Details, including the withdrawal instruction, are provided in the booking process.

§ 11 Participation at your own responsibility; liability

Participation in the Prevention Course is at your own responsibility. The Provider is liable without limitation for intent and gross negligence as well as for damage resulting from injury to life, body or health. In cases of slight negligence, the Provider is liable only for the breach of essential contractual obligations (cardinal obligations), limited to the foreseeable damage typical for the contract. Any further liability is excluded. Liability under the German Product Liability Act remains unaffected.

§ 12 Data protection

Information on the processing of personal data in connection with the Prevention Course (including health data pursuant to Art. 9 GDPR) is provided in the Provider’s privacy policy, available in the app and at jawbuddy.com/en/legal/privacy.

§ 13 Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods; vis-à-vis consumers, this choice of law applies only to the extent that it does not deprive them of the protection of mandatory provisions of the law of their habitual residence. Should individual provisions of these terms be invalid, the validity of the remaining provisions remains unaffected.
